Navy SEALs Win Major Legal Victory Against Biden’s Vaccine Mandate

(TeaParty.org Exclusive) – According to a new report from The Western Journal, a federal district judge has officially granted a preliminary injunction Monday against the enforcement of the current Department of Defense’s COVID-19 vaccine mandate against U.S. Navy SEALs.

A group of 35 Navy Special Warfare servicemembers filed a lawsuit against Joe Biden back in November 2021 which stated the directive which said they must get vaccinated or face a potential court martial or involuntary separation from the military that is a violation of their First Amendment right of religious liberty, as well as violating the Religious Freedom Restoration Act of 1993.

Texas-based Judge Reed O’Connor stated in his order that RFRA provides the, “Government may substantially burden a person’s exercise of religion only if it demonstrates that application of the burden to the person—(1) is in furtherance of a compelling governmental interest; and (2) is the least restrictive means of furthering that compelling governmental interest.”

“O’Connor, an appointee of former President George W. Bush, determined that the vaccine mandate substantially burdens the SEALs religious beliefs and the government has not shown requiring them to be vaccinated is the least restrictive means for furthering its interest of a healthy fighting force,” the WJ story stated.

“By all accounts, Plaintiffs have safely carried out their jobs during the pandemic. Prior to the vaccine mandate, at least six Plaintiffs conducted large-scale trainings and led courses without incident,” the judge wrote in his order.

“Even if Defendants have a broad compelling interest in widespread vaccination of its force, they have achieved this goal without the participation of the thirty-five Plaintiffs here,” the order continued. “At least 99.4% of all active-duty Navy service members have been vaccinated.”

Reed then went on to highlight that the Navy has granted exceptions for non-religious reasons, such as allergies or for individuals who are participants in other clinical trials, and allowed those sailors to still deploy.

“The 35 SEALs who have requested religious exemptions have cited their opposition to the use of aborted fetal cell lines in the development or manufacturing of the vaccines and their belief that ‘modifying one’s body is an affront to the Creator,’ among other issues,” the report said.

“The Navy servicemembers in this case seek to vindicate the very freedoms they have sacrificed so much to protect,” O’Connor went on to write.

“The COVID-19 pandemic provides the government no license to abrogate those freedoms. There is no COVID-19 exception to the First Amendment. There is no military exclusion from our Constitution,” he added.

First Liberty Institute, the organization that represented the SEALs in the lawsuit, celebrated the ruling.

“Forcing a servicemember to choose between their faith and serving their country is abhorrent to the Constitution and America’s values,” Mike Berry, General Counsel for First Liberty Institute, went on to say in a news release.

“Punishing SEALs for simply asking for a religious accommodation is purely vindictive and punitive,” he continued. “We’re pleased that the court has acted to protect our brave warriors before more damage is done to our national security.”

A report that was published when this all first started happening said, “According to a new report from Fox News, a brand new series of directives put out by the Navy are promising some very harsh punishments, including demotions, a ban on travel for SEALs and a cut in pay, for anyone in the Navy who refuses to comply with the vaccine mandate.”

“The same report reveals that for many SEALs, the process of getting approved for a religious exemption waiver is almost impossible. Which isn’t surprising at all. This is how the government forces all of us to comply. Make life extremely difficult until things reach a point that you have to choose between your sanity and getting the jab,” the report continued.

In the same report, Berry went on to note how dangerous it is to purge the military of key, elite servicemembers when it comes to our country’s national security. And he’s got a great point.

Biden and his administration are essentially playing politics with the very forces that serve, protect, and preserve our freedom and way of life. This could have had dire consequences on a number of matters that most of us aren’t even aware of.

We should definitely be happy that common sense prevailed to protect not only our national security, but also our freedom of religious expression and bodily autonomy when it comes to personal health care.

  1. I’d bet my last dollar Lt.Mike Byrd of the capital police couldn’t murder anyone of theses Navy Seals EVEN when they’re unarmed . True patriots indeed , not one sissyman in that group for sure !
